Terms of Service

1. Acceptance

By creating an account or using swiply.xyz (the “Service”) you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. The Service is operated by Tappz GmbH, a company registered in Germany (the “Company,” “we,” “us,” “our”). If you do not agree to these Terms, you must not use the Service.

2. Eligibility & accounts

You must be at least 18 years old and able to form a legally binding contract to use the Service. You are responsible for keeping your credentials secure and for all activity under your account. You agree to provide accurate information when registering and to keep it up to date.

3. The Service

swiply.xyz lets you connect one or more apps published on the Apple App Store, fetches their customer reviews via the App Store Connect API, drafts replies to those reviews using AI, and submits the replies you approve back to Apple on your behalf.

The Service is currently in beta and provided free of charge. We may introduce paid plans, usage limits, or change feature availability at any time with reasonable notice.

4. App Store Connect credentials

To use the Service you provide your App Store Connect API key (Issuer ID, Key ID, and the corresponding .p8 private key). The private key is encrypted at rest using AES-256-GCM with a per-row initialization vector and authentication tag, decrypted only inside server processes that need to sign requests to Apple, and never returned to the browser.

You represent and warrant that you are authorized to use the API credentials you provide and that providing them does not violate any agreement you have with Apple or any third party. You are responsible for managing the access scope of those credentials and for revoking them in App Store Connect if your relationship with the Service ends.

5. AI-generated content

Replies drafted by the Service are produced by large language models (currently Anthropic's Claude family) and may be inaccurate, inappropriate, or contain hallucinated facts. You are solely responsible for any reply you approve and submit to the App Store via the Service. You should review every draft before sending and edit it where needed.

The Service includes safeguards (prompt rules, output sanitisation) to discourage the model from inventing email addresses or referencing internal configuration, but no safeguard is perfect. Treat AI output as a draft, not a finished reply.

6. Acceptable use

You agree not to use the Service to:

• Send replies that violate Apple's App Store Review Guidelines or App Store Connect terms.
• Send replies that are unlawful, defamatory, harassing, hateful, misleading, or that infringe any third party's rights.
• Reverse-engineer, scrape, resell, or publicly disclose proprietary parts of the Service.
• Interfere with the Service's infrastructure or attempt to bypass authentication, rate limits, or security controls.
• Use the Service to compete with us by building a substantially similar product.

7. Workspaces & team members

A workspace owner may invite other users as members. The owner is responsible for the conduct of every member of their workspace and for any reply submitted from that workspace. Members can send replies on behalf of the workspace; remove members in Settings → Team if you no longer want them to have access.

8. Intellectual property

The Service, including its source code, design, and brand, is owned by Tappz GmbH and protected by international copyright, trademark, and other laws. You retain ownership of the content you submit (your app context notes, edits to drafts, etc.). You grant us a non-exclusive, worldwide license to process that content as needed to operate the Service, including sending excerpts to AI providers and the App Store Connect API.

9. Third-party services

The Service relies on third parties including Apple Inc. (App Store Connect API), Anthropic PBC (AI generation), Clerk Inc. (authentication), Neon Inc. (database hosting), Vercel Inc. (application hosting), Supermemory (long-term memory), and Loops (transactional email). Their availability and terms are outside our control; outages or changes on their side may affect the Service.

10. Termination

You may stop using the Service at any time by deleting your workspaces in Settings → Danger zone. We may suspend or terminate your access if you breach these Terms, if your use creates legal risk for us, or if we discontinue the Service. On termination, your encrypted credentials, app data, and AI memory are deleted.

11. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, secure, or produce specific outcomes. AI-generated drafts are not professional advice.

12. Limitation of liability

To the maximum extent permitted by law, Tappz GmbH and its affiliates, employees, and agents will not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the Service, including but not limited to lost profits, lost data, or harm to reputation resulting from a reply submitted via the Service. Our aggregate liability for any claim arising under these Terms is limited to the fees you paid us in the twelve (12) months preceding the claim, or 100 EUR if no fees were paid.

13. Indemnity

You agree to indemnify and hold Tappz GmbH harmless from any claim, damage, loss, or expense (including reasonable attorneys' fees) arising out of replies you submitted via the Service, your breach of these Terms, or your violation of any third-party rights.

14. Changes to these Terms

We may revise these Terms from time to time. Material changes will be announced on the Service or by email to workspace owners. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.

15. Governing law & jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is Munich, Germany, to the extent permitted by law.
